The powers of supervisory authorities should be exercised in accordance with appropriate procedural safeguards set out in Union and Member State law, impartially, fairly and within a reasonable time. Article 9. 1. The requested supervisory authority shall provide reasons for any refusal to comply with a request pursuant to paragraph4. CHAPTER 3 Fundamental Rights. Without prejudice to the tasks and powers of the competent supervisory authority and the provisions of ChapterVIII, a body as referred to in paragraph 1 of this Article shall, subject to appropriate safeguards, take appropriate action in cases of infringement of the code by a controller or processor, including suspension or exclusion of the controller or processor concerned from the code. 5. Where personal data are processed for the purposes of direct marketing, the data subject should have the right to object to such processing, including profiling to the extent that it is related to such direct marketing, whether with regard to initial or further processing, at any time and free of charge.
